Please Read Our Terms And Conditions Of Sale Carefully which
govern all purchases of goods from us.
These Terms and Conditions may be updated and edited at our
discretion. These terms may not be altered, supplemented, or amended by the use
of any other document (s).
By Completing an order in our shopping cart, you are stating that you are in agreement with
these terms and conditions.
We at Personalized Gifts inc and under any selling/website name take pride in
the items we sell to you. We make and resell some of the most desired
personalized items available today.
When personalizing items we use the utmost care to meet your desires to the best
of our ability, thus it is important that you take as much care in reading about
the product you are ordering and giving us your personalization
instructions. We cannot accept liability for incorrectly personalized
items if your instructions were not reasonably clear or if you didn't read about
the product (ie: the website states it's plastic, but you thought it was metal).
Photos & Files - When supplied with less than perfect photographs and digital files, we will
attempt to adjust your photo for its best output, however, we do not guarantee
color or photo quality of output. Between scan, print and press, colors may
shift. We cannot accept responsibility or returns unless we have made an
obvious error. Thus, if you send us a photo with trees and bushes in the
background, and the print is not exactly the same green as the photo, we cannot
take responsibility. Understandably, Personalized Items cannot be returned. However, if the green is red in our output, we
would notice and not send it to you, but in the event something slips through
quality control, we will re-make your order. Just notify us in
writing (e-mail) within 48 hours of receipt of your order.
There is no color matching with personalized products as is with promotional
items. Please Do Not ask for non standard colors or shades such as soft blue, vegas yellow, periwinkle blue, Silver, Strawberry Red,
light lilac, Gold, Hot Pink, etc etc. These colors are impossible
to create as well as the fact as they are also seen as different to each
person. If you do request odd colors, we will attempt to come as close as
possible to what we think that color is. We do not accept returns because the
color is not the shade you assumed.

Errors - Personalized items cannot be returned unless there is a
malfunction of parts or a spelling error on our part. For most items we will
send a sample graphic via e-mail for your approval, however, all monitor
resolutions differ and you must realize the colors you see may not be the colors
we see and certainly not be the colors printed. This is not to say that The
colors will be wrong, just that shades may shift slightly.
Please check any sample sent for design and
spelling to insure it's correctness. If you approve an item with spelling
errors, we cannot be responsible. We do understand that errors
happen and try to be as fair as possible, so if you've made an error and need to
re-order the product with it's correct personalization, we will offer you a 10 -
15% discount depending on the product.
If there is an error on our part, you must notify us by e-mail within 48 hours
of receiving your order and we will give you a RMA # for return. No items are accepted for return without authorization
by our office. If you send something back without an accurate RMA #
and your name clearly stated on the
outside of the box , it will be refused
at the post office. Items Authorized for return should be shipped back with all
it's original packaging and insured. At the time of authorization, we will
notify you which carrier to use to send it back. The return carrier is at
our discretion unless you are paying for return freight. You order
will be re-made and re-shipped as quickly as possible. No Refunds will be given.
E-mails -We are not responsible for lost or mis-directed e-mails. If our mail
server is down or your mail program rejects mail from us, we have no way of
knowing that you sent an email or you did not receive our email to
you. Please check all spam settings on your e-mail client and insure
that you are open to receiving mail from us. In the event our hosting server has
a problem and is down and e-mails are lost, we cannot accept responsibility.
Please be sure your email address is put in the shopping cart accurately. If
your email address bounces from the shopping cart, we cannot fill your order and
will not be able to contact you.
Most items from us are ordered as gifts, therefore, we refrain
from calling. Also, there are times that our production takes place late
at night which does not lend to calling customers. E-mail is our preferred
source of communication.
Production Time- Most items produced at our facility are made and
shipped within 5-7 days, some items 3-4 weeks, however, this is an estimate and may take longer
especially during heavy volume time, Holidays, Back To School, Special
events etc.. Any special design requests may take longer.
If you need your order by a certain date please make sure to tell us!
Please do not assume that because we estimate 5-7 days or 3-4 weeks that
your order will arrive on time. . If we feel we certainly cannot accommodate
your request, we will let you know. If under normal circumstances we feel
we can meet your date needs, we will continue with the process of your
order. We strive to insure your requested delivery date is achieved,
however this does not constitute a guarantee. Once your order has
been shipped, we are not responsible for carrier delays.
Shipping - Your order will be shipped via UPS, USPS, at our discretion.
We attempt to choose the best carrier available on the day your order ships to
get you your order in a reasonable time frame. Items produced
outside of our facility may take longer, Most outside manufactured items take
2-6 weeks for production depending on the item / factory. Freight Carrier is at the sole discretion of the
respective factory. After receipt of an item from a manufacturer other
than us, any communication about that item must be made through us.
Damage in Shipping - We pack our orders carefully and all items are in perfect
condition when they leave our facility. it is very rare that there is
damage during shipping, however, If an item is damaged in shipping, a claim must
be made with the freight carrier. If need be, we will assist you in this
claim. Please notify both us and the freight carrier within 24 hours of
receipt. Keep all packaging in the event the carrier wishes to inspect the
shipment.
Freight Surcharges & your Address - We do not allow for re-routing of our
shipments. Freight carrier charges for re-routing are hefty. If you
request a re-route from the freight carrier your credit card will be billed $
8.00 or $ 16.00 depending on the charge imposed by the carrier. It is
important that you give us a suite #, Apartment # or any important info
concerning your address. UPS will charge the re-routing fee if these items
are missing from your address and in turn you will be charged.
For your protection, we prefer to only ship to your credit card billing address as
requested by your credit
card issuing bank. We do, however, realize that there are times when it is
necessary to ship to your office or gift recipient. If you request
shipping to an address other than your billing address, your name and billing
info is checked with your credit card issuing bank. If your address info
matches, then you are liable for the order and may not claim it to be
fraudulent. If you have lost your credit card or if your info has been
compromised in any way then it is your responsibility to inform your issuing
bank and close your account so charges will not be approved.
Communication & Changes to your order - It is important that you
check your e-mail on a regular basis. We may send samples or have question
pertaining to your order. Delay in your response to us is a delay in
production of your order. Once a sample is approved your order process
continues. If you request editing or re-design, your order goes back into
the art department and may take a few days for re-sampling. We prefer all
correspondence is made via e-mail so there is a record for review, less
errors happen that way, However, please try to keep your emails precise and to a
minimum. We request you attempt to give the most accurate info during the
order process. We will make our best efforts to alter your
personalization after the order has been received, however, we cannot guarantee
any changes as it depends on how far the order has progressed.
Payment - All payments are made in advance. Credit Cards are charged
prior to production. Checks & Money Orders Received are deposited and must
clear prior to production. This can sometimes take up to 10 business days.
Returned Checks incur a $ 35.00 surcharge. Note: Starter Checks are not
accepted for payment. Any charges not paid will go to
collection.
Cancellation Penalty - Once you have placed your order, it is not subject to
cancellation.
In the event of extenuating circumstances and you must cancel, penalty charges
may apply.
If the order was just received an not processed in any way there will be no
penalty.
If your credit card has already been charged and it is in the same day as the
charge, there will be a $ 3.50 processing fee deducted from your refund.
If your credit card has already been charged on a prior calendar day, 10% + 3.50
will be deducted from your refund amount as we are charged this by your credit
card bank for canceling the charge.
If artwork has been done for the product, 25% will be deducted from your
refund.
If a print has been made 40% will be deducted.
If your item has already been created 80% will be deducted.
Our Right to Cancel - Refuse Service
We reserve the right to cancel your order at no penalty to you for any reason.
We reserve the right to refuse orders that are of an adult or pornographic
nature.
We reserve the right to refuse orders that are in a different language if we
cannot find the meaning, or find the meaning to be inappropriate.
We reserve the right to refuse orders from out of the United States.
We will not ship to a freight forwarder.
Professional Photography - We require that all professional photographs are
accompanied by the photographers release. Please do not send professional
photographs without said release. Any professional photograph sent to us without
a release will not be returned unless you send us a self addressed stamped
envelope.
Web images. Just because an image is on the world wide web, does not
put it in public domain. Please do not send images that you have copied
off the web unless you have permission to use it. Most web images are
72dpi and are not print quality this includes images from your online photo
album.
CUSTOMER REPRESENTS AND WARRANTS:
THAT HE/SHE IS OWNER OF THE PHOTOGRAPH (OR HAS PERMISSION); THAT IT IS NOT A COUNTERFEIT OR STOLEN ITEM; THAT IT DOES NOT INFRINGE ANY THIRD PARTY'S COPYRIGHT, LICENSE, PATENT, TRADEMARK, TRADE SECRET OR ANY OTHER PROPRIETARY RIGHTS OR RIGHTS OF PRIVACY; THAT THE PHOTO DOES NOT VIOLATE ANY LAW, STATUTE, ORDINANCE OR REGULATION (INCLUDING WITHOUT LIMITATION THOSE GOVERNING IMPORT/EXPORT CONTROL, CONSUMER PROTECTION, UNFAIR COMPETITION, ANTI-DISCRIMINATION OR FALSE ADVERTISING); THAT THE PHOTO WILL NOT BE OBSCENE OR CONTAIN CHILD PORNOGRAPHY; AND THAT THE PHOTO SHALL NOT CREATE LIABILITY FOR
Personalized Gifts Inc.. CUSTOMER AGREES TO INDEMNIFY AND HOLD
Advertising Angel, inc., ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING BUT NOT LIMITED TO REASONABLE ATTORNEY'S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF CUSTOMER'S BREACH OF THIS AGREEMENT AND/OR CUSTOMER'S VIOLATION OF ANY LAW OR THE RIGHTS OF ANY THIRD PARTY. WE ALSO RESERVE THE RIGHT TO REFUSE TO PROCESS ANY ORDER WE DEEM TO BE OFFENSIVE IN ANY MANNER.
Security/Privacy - Your Security is important to us. Your credit
cards are charged off line. Your information is kept in the secure shopping cart
until your order has shipped and then it is deleted. We do not engage in
spamming practices. We do not sell, lend or share our customer list with
anyone. If you have agreed to receive our newsletter announcing new items or
extending special discounts to our subscribers then you will receive mail
from us usually on a monthly basis. You have the option of
unsubscribing from our newsletter at any time. There is always an
unsubscribe link at the bottom of each newsletter. Otherwise, your information
is used solely for your order process and obtaining info from you pertaining to
your order.
~With all that said, Most of these issues never come up as 99.9%
of our customers have been very happy with us and we have been equally as happy
to serve them. Many customers become friends and part of our extended
family. We process their gifts on an annual basis and enjoy watching their
families grow. However, the internet is a big place and there is always that 01%
chance of a problem, therefore these terms and conditions have been stated to
insure that industry standards are understood. These terms may be amended by us
at any given time, so if you're unsure, it's best to check back prior to placing
your order. We are always thrilled to personalize your day and do our
utmost to insure your satisfaction!
